Civil liability law
Civil liability law allows anyone who has suffered damage to obtain compensation from the person responsible, whether on the basis of fault or of a statutory strict liability. In Geneva, our firm assists people who have suffered bodily injury following an accident or an offence, as well as those in dispute with an insurance company over the scope or amount of their compensation. We act both in negotiation and in litigation before the civil courts.
FORI Avocat·e·s SA assists people who have suffered bodily injury following an accident – whether a road accident, a domestic or leisure accident, or an accident occurring in a work context – in assessing and presenting their claims for damages and satisfaction within the meaning of the Code of Obligations (Art. 41 et seq. CO). For each client we establish the calculation of the damage suffered – uncovered medical costs, current and future loss of earnings, impairment of economic prospects – working, where necessary, with medical and actuarial experts.
Our firm also acts in disputes between our clients and their insurance company, whether the opposing party's civil liability insurer, accident insurance (AIA) or other insurance, in particular where the insurer disputes the causal link, reduces its benefits or refuses to consider the claim. We negotiate with insurers and, where no agreement is reached, take the dispute before the competent courts.
Finally, we assist victims of offences or accidents in obtaining full compensation, coordinating, where appropriate, the civil claims with the criminal proceedings or with the steps opened under the Victim Support Act (LAVI), so as to ensure consistent compensation for all heads of damage.
