Acquiring Swiss nationality follows a multi-level procedure – federal, cantonal and communal – whose conditions and time limits vary according to each person's situation. In Geneva, our firm assists those wishing to obtain Swiss nationality, whether by the ordinary or simplified route or by reinstatement, as well as those facing a refusal or a delay in the handling of their file. We act both in an advisory capacity, in putting the file together, and in litigation, before the competent authorities and courts.
FORI Avocat·e·s SA advises and represents those wishing to acquire Swiss nationality by the ordinary route, within the meaning of the Federal Act on Swiss Citizenship (LN): verification of residence and integration conditions, compilation of the file with the competent cantonal office and then during the communal, cantonal and federal examination. We also assist our clients with simplified naturalisation, in particular for spouses of Swiss nationals, and with reinstatement procedures.
Where an application is refused, suspended or subject to unjustified delay, we assist our clients in drafting objections and appeals before the competent cantonal authorities and then, if necessary, before the Federal Administrative Court. We act in particular where the refusal rests on a questionable assessment of the criteria of integration, respect for the legal order or knowledge of Swiss realities, as well as in cases of withdrawal of nationality for false declarations.
